Laurent Koscielny has upset the apple cart at Arsenal this summer by refusing to travel on the club's pre-season tour to the USA.

"These criteria shall include, in particular, the remuneration and other benefits due to the player under the existing contract and/or the new contract, the time remaining on the existing contract up to a maximum of five years, the fees and expenses paid or incurred by the former club (amortised over the term of the contract) and whether the contractual breach falls within a protected period."

Manchester United, for example, terminated Fabian Barthez's contract back in 2004 and agreed to pay him the remainder of his one-year contract - or a little under £2.5million.

Terminating his contract without just cause would mean Arsenal are liable to pay him compensation for the remainder of his one-year contract.

Because he is over the age of 28, under FIFA law Koscielny's protected period under his contract expires two years after signing it.

"In all cases, the party in breach shall pay compensation," FIFA regulations state.

In response, the club are to open disciplinary proceedings against Koscielny, who wants his contract terminated.
